On occasion, we will receive a call from someone who is looking to hire an attorney to see if we charge a flat fee. There are certain areas of law where a lawyer can charge a fee in advance and does all the work done in a file or on a contingency basis, which receive the attorney payment or reimbursement of all filing fees and work done in the case after the case is over, such as a personal injury case. Divorce cases, however, fall into either of these categories. Unlike other types of cases, there is no way to estimate for the total amount of time spent in a divorce case because the amount of time varies from case to case. Each divorce is unique and no two divorces are alike.

In divorce cases, law firms generally bill your client on an hourly basis. Before the attorney begins work on a client’s behalf, however, the attorney requires its customers to sign a repayment agreement and pay a retainer. The fee agreement is a contract between the client and the lawyer and explained in detail what the customer can expect from your lawyer. Georgia law expressly provides that the award of attorney’s fees will be at the discretion of the court, provided the court uses the financial circumstances of both sides a part of its determination. OCGA § 2.6.19 (a) (1). The fees can be awarded in full at the end of the divorce proceedings. OCGA § 2.6.19 (a) (2). Attorney’s fees may be awarded at a temporary hearing, the final hearing, or both, if the financial circumstances justify the awards. OCGA § 2.6.19 (b). Like any other order, the award of attorney’s fees may be imposed for a contempt action.

A temporary protective order can be issued against someone who does not live in Georgia. O.C.G.A. § 19-13-2 gives courts in Georgia some control over a nonresident charged with committing an act of family violence. Georgia will not only have jurisdiction over the non-resident if he or she, either in person or through an agent, commits ans injury in Georgia caused by an act or omission outside of Georgia and the non-resident makes one of the things following:

• regularly does business in Georgia, or
• Participate in any other conduct in the state of Georgia, or
• They derive substantial revenue from goods used or consumed for services rendered in Georgia.

However, if the act of family violence is the placement of harassing or intimidating phone calls or text messages to a person in Georgia, this is not sufficient to give Georgia jurisdiction. The act of domestic violence is considered to have occurred in the State where the telephone call was made or from which the text message was sent. If phone calls or text messages from someone outside the state are the only acts of violence in the family, Georgia can not have jurisdiction over the defendant.

Georgia Child Custody and Support Guidelines:

Custody may be awarded to either parent based on the best interest of the child or children and what will best promote their welfare and happiness. If the child has reached the age of 14 years, the child shall have the right to select the parent with whom he or she desires to live. The child’s selection shall be controlling, unless the parent so selected is deemed unfit to have the custody of the child. In all cases in which the child has reached the age of at least 11 but not 14 years, the court shall consider the desires, if any, and educational needs of the child in determining which parent shall have custody. The court at any temporary or permanent hearing may grant sole custody, joint custody, joint legal custody, or joint physical custody where appropriate. [Based on Georgia Code - Sections: 19-9-1 and 19-9-3]

Child Support:

Georgia uses an income-shares model to determine the amount of child support. The court will consider the existence of special circumstances and may adjust child support based on:

• Ages of the children.
• A child’s extraordinary medical costs or needs in addition to accident and sickness insurance, provided that all such costs or needs shall be considered if no insurance is available.
• Educational costs.
• Day-care costs.
• Shared physical custody arrangements, including extended visitation.
• A party’s other support obligations to another household.
• Income that should be imputed to a party because of suppression of income.
• In-kind income for the self-employed, such as reimbursed meals or a company car.
• Other support a party is providing or will be providing, such as payment of a mortgage.
• A party’s own extraordinary needs, such as medical expenses.
• Extreme economic circumstances including but not limited to, unusually high debt structure or unusually high income of either party or both parties, which shall be construed as individual gross income of over $75,000.00 per annum.
• Historical spending in the family for children which varies significantly from the percentage table.
• Considerations of the economic cost-of-living factors of the community of each party.
• In-kind contribution of either parent.
• The income of the custodial parent.
• The cost of accident and sickness insurance coverage for dependent children included in the order.
• Extraordinary travel expenses to exercise visitation or shared physical custody.
• Any other factor which the trier of fact deems to be required by the ends of justice, as described below:

A non-custodial parent may be ordered to provide insurance for the child or children for so long as he or she is obligated by this order to provide support. Where applicable, the court shall also include income deduction orders. [Based on Georgia Code - Section: 19-5-12].
